for the Use of the Mobile Application  

"Daily motivation quotes app"

This offer is addressed to individuals and constitutes a public proposal by “BP Tech" LLP (hereinafter referred to as "BP Tech" LLP) to enter into a license agreement granting a non-exclusive right to use the software "Daily motivation quotes app" under the terms of a simple (non-exclusive) license and the provisions of the license agreement (hereinafter referred to as the "Agreement"). The rights holder of the "Daily motivation quotes app" Mobile Application is "BP Tech" LLP.  

1. Terms and Definitions  

1.1. For the purposes of this Agreement, the terms below shall have the following meanings:  

1.1.1. End User – An individual who has entered into the License Agreement (by accepting this offer) with the Licensor.  

1.1.2. Licensor – "BP Tech" LLP

1.1.3. Mobile Application – A set of software products owned by the Rights Holder, accessible via a mobile application installed by the User on a device.  

The Mobile Application is available for download on:  

- The Google Play Store  

- The HUAWEI AppGallery  

1.1.4. User Rights – The User may install an unlimited number of copies of the Mobile Application, provided that: only one version of the Mobile Application per User account may be used on a single Device.  

1.1.5. Conclusion of the License Agreement (Acceptance of the Public Offer) – Full and unconditional acceptance of the terms of this License Agreement by the End User, evidenced by the End User performing any of the following actions:  

- Installing the Mobile Application on a smartphone;  

- Initiating use of the Mobile Application.  

1.1.6. Mobile Application Usage Rules (hereinafter "Rules") – Guidelines outlining the general terms for granting a non-exclusive license to use the Mobile Application, including prohibited actions and liability limitations.  

1.1.7. User Profile – The End User’s personal page within the Mobile Application, accessible after authorization.  

1.1.8. License Territory – Worldwide.  

2. Terms and Conditions of Service Provision  

2.1. To access the Services, the User must complete the registration process in the application, after which they will gain access to the core functionality of the Mobile Application, which includes both free and paid features. By accessing the Mobile Application’s functionality, the User accepts this Offer, thereby entering into a License Agreement with the Licensor.  

During registration, the User must provide:  

- Email address  

- Password  

2.2. To access additional (paid) features, the User must make a payment equivalent to 100% of the feature’s cost, either through: a monthly subscription, or an annual subscription via the Google Play Store or HUAWEI AppGallery.  

Prices for paid features are displayed within the Mobile Application.  

2.3. Upon successful payment, the User is automatically granted access to the additional features.  

2.4. To ensure high-quality service, the Licensor reserves the right to temporarily suspend the Mobile Application for: technical maintenance, system updates, or other modifications. Users will be notified in advance whenever possible.  

2.5. The Licensor does not guarantee that the Mobile Application will operate:  

uninterruptedly,  without delays, or  error-free.  

3. Payment Terms

3.1. Payment for Services provided to the User shall be made in full (100% prepayment). License fees shall be charged according to the rules of the distribution platform store and in the currency supported by such platform.

3.2. The Licensor uses independent financial institutions (payment systems) to process payments. Therefore, all payment terms and refund conditions must comply with the current rules of the financial institution processing the payment for the Licensor's services.

3.3. Paid features become active on the day payment is received.

3.4. Subscriptions automatically renew for the same period unless canceled by the User.

3.5. Subscriptions may be managed or canceled through the User's account settings in Google Play or HUAWEI AppGallery.

3.6. If the User terminates this Agreement prior to actual receipt of Services, any payments made shall under no circumstances be refundable.

 4. Responsibilities of the Parties

4.1. User Responsibilities:

4.1.1. Keep login credentials confidential and not share them with third parties.

4.1.2. Respect the Licensor's copyrights by not copying or distributing substantial portions of the application's content, and not using the application in ways that violate third-party rights.

4.1.3. Independently review this Agreement, its terms, and pricing for Additional Features as displayed in the application.

4.1.4. Maintain necessary technical requirements (internet access, modern smartphone/tablet) for using the application.

4.1.5. Provide accurate information in the application for proper functionality.

4.1.6. Make timely payments and retain payment confirmation documents throughout the usage period.

4.1.7. This Agreement becomes effective upon application installation and remains valid indefinitely.

4.2. Licensor Responsibilities:

4.2.1. Provide Additional Features according to received payments.

4.2.2. Maintain User data confidentiality unless required by law or with User's explicit consent.

4.2.3. Notify Users of pricing changes for Additional Features through in-app announcements.

5. Force Majeure

5.1. Parties shall be exempt from liability for partial or complete failure to fulfill obligations if caused by force majeure.

5.2. Force majeure events include: natural disasters, government actions, war, cyber attacks, or technical failures beyond either party's control.

5.3. In case of force majeure, contractual obligations shall be suspended for the duration of such circumstances.

6. Agreement Modifications

6.1. This Agreement becomes effective upon application installation.

6.2. The Licensor may unilaterally modify this Agreement, with changes taking effect upon publication in the application.

6.3. Continued use constitutes acceptance of modified terms. Users who disagree must discontinue use.

7. Privacy Policy

7.1. General Provisions

This Privacy Policy describes how “BP Tech” LLP (hereinafter referred to as the Licensor) collects, uses, processes, and protects personal data of users of the "Daily motivation quotes app" Mobile Application (hereinafter referred to as the Application).

By installing and using the Application, the User confirms their consent to this Privacy Policy.

7.2. Collected Data

The Application may collect the following categories of data:

• Account data: email address and password (used for registration and authentication);

• Technical data: operating system version, app version (used to ensure compatibility and analytics);

• Usage data: frequency of app launches, interaction with content, and subscription information, language settings (used for improving user experience);

• Purchase data: information about subscriptions and payments processed by HUAWEI AppGallery or Google Play Store  (collected by those platforms according to their privacy policies).
  
  

7.3. Purpose of Data Collection

User data is collected and processed for the following purposes:

• to ensure proper operation of the Application and its features;

• to provide access to paid and free functionality;

• to improve and personalize user experience;

• to process payments and manage subscriptions;

• to comply with applicable laws and regulatory requirements.
  
  

7.4. Data Processing and Storage

The Licensor ensures data protection through organizational and technical measures preventing unauthorized access, modification, or disclosure.

 Personal data is stored only for the period necessary to fulfill the stated purposes or as required by law.

 User passwords are encrypted and never stored in plain text.

7.5. Sharing and Transfer of Data

The Licensor does not transfer personal data to third parties, except in the following cases:

• when required by law or court order;

• when necessary to provide services (e.g., payment processing via HUAWEI AppGallery or Google Play Store);

• with the User’s explicit consent.
  
  

7.6. Third-Party Services

The Application may use third-party SDKs or analytical tools such as:

• Google Firebase Analytics (to analyze app usage and performance);

• Payment systems of HUAWEI AppGallery or Google Play Store (for handling transactions).

Each third-party service processes data in accordance with its own privacy policy. Users are encouraged to review the privacy policies of these services.

7.7. User Rights

The User has the right to:

• request access to their personal data;

• request correction or deletion of personal data;

• withdraw consent to data processing (which may limit access to some Application features);

• contact the Licensor regarding data protection issues.

7.8. International Data Transfers

User data may be stored or processed on servers located outside the User’s country of residence, provided that adequate data protection standards are ensured.

7.9. Children’s Privacy

The Application is not intended for users under 4 years old. The Licensor does not knowingly collect personal data from minors. If such data is discovered, it will be promptly deleted.

7.10. Changes to the Privacy Policy

 The Licensor reserves the right to update this Privacy Policy at any time.

 Updated versions will be published within the Application and take effect immediately upon publication.

 Continued use of the Application after such changes constitutes acceptance of the updated Privacy Policy.
